El presente trabajo se enmarca dentro de las reflexiones contemporáneas acerca de la interacción entre el teísmo y el ateísmo. La idea principal que se sostiene es la posibilidad y necesidad de conciliar armónicamente las nuevas visiones de la realidad generadas por los avances tecnocientíficos, los cambios sociales, y el lugar que hoy ocupan la religiosidad tradicional o institucional de índole trascendente y la espiritualidad inmanente producto del naturalismo filosófico. El objeto del trabajo es pues ahondar sucintamente en las causas, (...) fundamentos y problemáticas de la espiritualidad naturalizada. En este sentido, se pretende examinar las limitaciones y dificultades que presentan las increencias pretendidamente espirituales y antirreligiosas basadas en postulados inmanentistas y cientificistas. Se proyecta necesario y fecundo un esfuerzo en el diálogo y conocimiento recíproco por parte de la pluralidad de posiciones existentes, principalmente entre la espiritualidad trascendente y la naturalizada. The purpose of this paper is to analyze the virtue of temperance as a moral competence in professional performance. The analysis relies on three different streams of literature: virtue ethics, positive psychology and competency-based management. The paper analyzes how temperance is defined in each of these perspectives. The paper proposes an integrative definition of temperance as “moral competence” and summarizes behaviors in business environments in which temperance plays a role.

We propose for their model another way to construct functions: Multiple Kernel Contraction, that is a modification of Kernel Contraction, proposed by Hansson [Han94] to construct classical AGM contractions and belief base contractions. Content-based authorship identification is an emerging research problem in online social media networks, due to a wide collection of issues ranging from security to privacy preservation, from radicalization to defamation detection, and so forth. Indeed, this research has attracted a relevant amount of attention from the research community during the past years. The general problem becomes harder when we consider the additional constraint of identifying the same false profile over different social media networks, under obvious considerations. Inspired by this emerging (...) research challenge, in this paper we propose and experimentally assess an innovative framework for supporting content-based authorship identification and analysis in social media networks. Este trabajo analiza los aspectos más destacados de la polémica entre Juan Carlos Bayón y Eugenio Bulygin acerca de las lagunas jurídicas, el principio de prohibición y el alcance de la discreción judicial. En esta disputa, Bulygin defiende cuatro tesis centrales, enunciadas en Normative Systems : una cuidadosa distinción entre normas y proposiciones normativas es esencial para resolver el problema de las lagunas jurídicas, la versión débil del principio de prohibición no sirve para mostrar que no existen lagunas, la (...) versión fuerte del principio de prohibición es verdadera solo cuando el sistema es completo, y en casos de lagunas jurídicas, los jueces tienen discreción para resolver estas situaciones. Sin embargo, Bayón señala que el problema no es la falta de distinción entre normas y proposiciones normativas sino el desacuerdo acerca de cuándo una solución jurídica es concluyente. La diferencia entre soluciones prima facie y concluyente es esencial porque en ciertas situaciones, el derecho no da una respuesta pero tampoco deja espacio para la discrecionalidad judicial. Según Bayón, en estos casos el principio de prohibición "todo lo que no está prohibido está permitido" juega un papel fundamental. Este trabajo muestra que los argumentos de Bayón son insuficientes para rechazar las tesis clásicas defendidas por Bulygin. In this paper I analyze the most relevant aspects of the controversy between Juan Carlos Bayón and Eugenio Bulygin about the existence of legal gaps, the so called "principle of prohibition" and the scope of judicial discretion. In this debate, Bulygin defends four classical theses advanced in his wellknown book, Normative Systems : a careful distinction between norms and norm propositions is actually needed in order to solve the problem of legal gaps, the analytical truth of the weak version of the principle of prohibition cannot guarantee the completeness of legal systems, the strong version of the principle of prohibition is true only if legal systems are complete, and judges have discretion in cases of legal gaps. However, Bayón claims that the problem is not the lack of distinction between norms and norm proposition but rather the identification of conclusive legal solutions. Conclusive legal solutions must be distinguished from the prima facie solutions provided by explicitly enacted norms. According to Bayón, the difference between conclusive and prima facie solutions is essential in legally irrelevant cases; in such cases the principle of prohibition plays an essential role because it entails the rejection of judicial discretion. In this paper I claim that the arguments advanced by Bayón fail to provide a sound ground for discarding the classical theses defended by Bulygin. (shrink)

In March 2021, the Spanish Congress approved the law regulating euthanasia, that regulates both euthanasia and physician-assisted suicide (PAS). In this article, we analyse the Spanish law regulating euthanasia and PAS, comparing it with the rest of the European laws on euthanasia and PAS (Netherlands, Belgium and Luxembourg). Identified strengths of the Spanish law, with respect to other norms, are that it is a law with many safeguards, which broadly recognises professionals’ right to conscientious objection and the specification that it (...) makes on the prior comprehensive care of the patient, including the approach to care dependency. Regarding its shortcomings, the law does not differentiate well between euthanasia and PAS; it barely assigns a role to the healthcare team as a whole (similar to other regulations); it does not clarify the functions of the different professionals involved; it does not detail the specific composition and duration of theevaluation commission; it has not been accompanied by a prior or simultaneous regulation of palliative care; and, lastly, the period of time to implement the law is too short. According to some authors, Latour’s attention to politics during the last decades is the result of his proposing a different approach to politics that entails, with respect to his overall project, one of two situations. Either his epistemological proposal has suffered a “normative turn”—which necessarily breaks with the previous assumptions of Actor-Network Theory (ANT); or, if ANT’s view on technosciences remains valid, his political proposal becomes not possible as a new normative approach. In this paper, I will focus on the (...) critique voiced by John Law, as well as Graham Harman. I will argue that this is a false dilemma because there has not been a change in Latour’s conceptual basis, nor a lack of coherence within his thought that would undermine the democratic commitment of his Political Epistemology. I will justify this by exposing the fact that Latour’s overall project, as part of Science Studies, has not lately followed a “political” but an “ontological” turn, which has been underling his works since the very beginning of ANT. We say that a sentence A is a permissive consequence of a set X of premises whenever, if all the premises of X hold up to some standard, then A holds to some weaker standard. In this paper, we focus on a three-valued version of this notion, which we call strict-to-tolerant consequence, and discuss its fruitfulness toward a unified treatment of the paradoxes of vagueness and self-referential truth. For vagueness, st-consequence supports the principle of tolerance; for truth, it supports the (...) requisite of transparency. Permissive consequence is non-transitive, however, but this feature is argued to be an essential component to the understanding of paradoxical reasoning in cases involving vagueness or self-reference. Este trabajo esboza un programa de investigación que anuda la fenomenología del cuerpo con la paleontología humana y con la antropología filosófica, a fin de examinar si y en qué medida los vínculos existentes entre la experiencia corporal, la imaginación y la memoria pueden formalizarse en términos geométricos tales como la verticalidad y, en ese sentido, constituir una base para la determinación simbólica de fenómenos orgánicos.

Cet essai soulève quelques questions sur les contours de ce devoir et suggère des moyens de renforcer la théorie. En particulier, il suggère d'intégrer une vision cosmopolite de la portée de ce devoir, d’éclairer les caractéristiques à la base du statut moral égal des personnes afin d'en identifier les fondements, ainsi que d'identifier certaines considérations relatives à (...) des intérêts d'importance afin d'en préciser le contenu. How should political power and influence be allocated in democratic systems? That is, roughly, the core of the boundary problem in democratic theory. As of late, some authors have begun paying increased attention to the methodological aspects of this dispute. This paper attempts to make a twofold contribution to this ‘methodological turn’. On the one hand, it identifies and analyzes five desiderata of a successful principle of democratic inclusion. Any such principle, I argue, must be grounded in a clearly identifiable (...) set of values, must provide a clear standard of inclusion, must specify the relevant modalities of inclusion, must provide sound bridging principles, and must be extensionally adequate. In the first half of the paper, these desiderata are developed and critically scrutinized. On the other hand, I also extract three lessons from the previous discussion. First, that a unique answer to the boundary problem (i.e. one grounded in one single principle) is unlikely. Second, that a satisfactory answer to the boundary problem need not necessarily appeal, as some have argued, to distinctively democratic values. And third, that intuitions about political exclusion (i.e. those requiring or permitting the exclusion of some individuals) should be treated with special caution. (shrink)

La mal llamada “Conquista del Desierto” constituyó una serie de campañas militares ocurridas en el actual territorio patagónico argentino entre los años 1878 y 1885 cuyo resultado fue el asesinato, la violación y sometimiento a la esclavitud de diversos pueblos y comunidades indígenas. Este no fue un caso aislado, sino que se suma a una serie de ataques sistemáticos que han sufrido los indígenas en la Argentina. En los últimos años, a raíz del reclamo y las luchas de los pueblos (...) y comunidades indígenas, así como también de las organizaciones de derechos humanos, se han comenzado a juzgar algunos de estos hechos. En particular, la Masacre de Napalpí (1924) y la Masacre de La Bomba (1947) fueron los primeros que lograron respuestas judiciales favorables. En ambos se determinó que el accionar estatal era constitutivo de un genocidio y, por lo tanto, se debía resarcir a las comunidades actuales. Ahora bien, la Campaña del Desierto, al día de hoy, no tiene respuesta por parte del Estado. Teniendo presente este panorama, nuestro objetivo en este trabajo es reconstruir los diferentes problemas que enfrenta la posibilidad del reclamo judicial. Para ello, comenzaremos describiendo en qué consistió la Campaña del Desierto. Luego, explicaremos la noción de genocidio aplicado a hechos de injusticias históricas. Como tercer paso, reconstruiremos los casos jurisprudenciales que se han preocupado por genocidios indígenas ocurridos en el pasado. Con este panorama revelado, nos enfocaremos en los diferentes problemas jurídicos y políticos que surgen en los reclamos de justicia. (shrink)

This paper is a critical and comparative legal historical study, which offers a global vision of the U.S. Legal System, according to the religious factor impact and its complex dimensions (e.g. religious liberty, Church-State relations, welfare state & solidarity). The principal goal is the deconstruction of the fake official History, elaborated after the Second World War (e.g. inferences, impostures, fallacies). At the same time, it shows the social development (and the kind of commitment in each period), and how it happens (...) the consolidation of the system thanks to the regulation. In this way, it is possible to pay attention to the American experimental evolution (not lineal or exceptional –as many U.S.hand-books pretend): from colonial Blue Laws (or Sunday regulation), up to the current regulation on freedom of religion and non-discrimination. Also, this paper offers a systematic set of diverse legal sources (e.g. Executive orders & rules, Legislative statutes, Judicial cases & resolutions). Another goal of this paper is the evaluation of the allegedly paradoxical policies and regulations in this field, during the last two Administrations (Clinton and W. Bush); both of them, from extreme views (linked at the end), they used incorrectly the religious factor, and they confused the institutions. Since March 14, 2020, Spanish citizens have been confined to their homes due to the impact of the COVID-19 pandemic. Participating in musical activities has been associated with reduced anxiety and increased subjective wellbeing. The aim of this study is to analyze how Spanish citizens used music during the lockdown period. We also study perceptions of the impact music has in everyday life, in particular examining the respondents’ insights into the effects of listening to music in situations of isolation. The (...) study was conducted using the MUSIVID19 questionnaire administered to a total of 1868 Spanish citizens. The results indicate that during lockdown, respondents perceived an increase in the time they devoted to musical activities such as listening, singing, dancing or playing an instrument. The participants also reported using music to cope with the lockdown, finding that it helped them to relax, escape, raise their mood or keep them company. The findings suggest an improvement in their perception of the value of music in personal and social wellbeing during the lockdown. However, the study reveals significant differences in the use and perceptions of music according to respondents’ personal situations. Age and feelings of vulnerability may lead to more conservative uses of musical practice and to more moderate perceptions of the positive values of music. (shrink)

Al efecto, señala la importancia del estudio del genoma humano como fundamento de una reflexión filosófica de segundo grado sobre la naturaleza del ser humano, subrayando las grandes similitudes entre el Homo sapiens y las especies evolutivamente más próximas. Además, a partir del estudio del ADN mitocondrial y del cromosoma Y, centra la atención en el principio de coalescencia evolutiva entre seres humanos, gracias al (...) cual es posible afirmar que todos ellos son miembros consanguíneos de un mismo linaje. In this chapter we use methods of corpus linguistics to investigate the ways in which mathematicians describe their work as explanatory in their research papers. We analyse use of the words explain/explanation (and various related words and expressions) in a large corpus of texts containing research papers in mathematics and in physical sciences, comparing this with their use in corpora of general, day-to-day English. We find that although mathematicians do use this family of words, such use is considerably less prevalent (...) in mathematics papers than in physics papers or in general English. Furthermore, we find that the proportion with which mathematicians use expressions related to ‘explaining why’ and ‘explaining how’ is significantly different to the equivalent proportion in physics and in general English. El ensayo consta de tres partes: primera, un breve estudio histórico del surgimiento de las políticas radicales, con especial atención al papel político desempeñado en Europa a lo largo del siglo XVI por las revoluciones sociales inspiradas en el cristianismo reformado. Segunda, una lectura crítica de la secularización como paradigma de modernización que transformó a los dioses movilizadores del radicalismo político. Incluye un comentario del debate entre Karl Löwith y Hans Blumenberg en torno al surgimiento de una concepción moderna de (...) la temporalidad histórica y a la relación entre progreso y escatología. Y una tercera, un apunte filosófico sobre el desplazamiento semántico del término «extremismo» como síntoma del olvido posmoderno de lo político. Finalmente, el análisis histórico de las relaciones entre extremismos y desencantamiento se centra en la importancia que adquiere la ficción como figura del poder político. (shrink)

This is a critical-hermeneutical and historical-comparative study on Political Economy, Economic History and Social Thought, applied to the American utopias in the 19th century and its role in the colonisation of the United States (US) west. This review is based on a heterodox economic approach, used in the disciplines of Religion and Economics. It gives a general view of religious and ideological utopias, as cooperative enterprises of intentional life in farms and workshop, making a comparative analysis of efficiency and sustainability. (...) This study attempts to explain the colonial paradox of American utopias because the last established, with more inversion, they were the first to fall. This study shapes the development of the western territories, from the Quaker’s Holy Experiment framework and its support for the utopias experiments in the expansion to Ohio, Indiana and Illinois. Contribution: This review offers a descriptive and explanatory study on the colonisation of the US west, under the hermeneutical turn from heterodox economic approaches, to deal with some current contradictions and anachronism in the mainstream view. This article explains the History (past reality), the Historiology (the theories and methods to study the past), and the Historiography (the academic literature) about Cross-Cultural Studies in the U.S.A., from traditional and native subjects (i.e. American Studies), until the current version. It pays attention to religion, as a relevant factor in the evolution of U.S. culture and its model of social relations. En este artículo se explica la Historia (la realidad pasada), la Historiología (las teorías y métodos con los que (...) se estudia dicho pasado), y la Historiografía (la literatura académica al respecto) de los estudios interculturales en los EE.UU., desde las primeras disciplinas tradicionales y nativistas (e.g. Estudios Estadounidenses), hasta los actuales estudios interculturales. Se presta especial atención al factor religioso, pues ha sido muy influyente en el devenir de la cultura estadounidense y en sus relaciones sociales. (shrink)

While the very existence of global literary studies as an institutionalised field is not yet fully established, the global turn in various disciplines in the humanities and the social sciences has been gaining traction in recent years. This book aims to contribute to the field of global literary studies with a more inclusive and decentralising approach. Specifically, it responds to a double demand: the need for expanding openness to other ways of seeing the global literary space by including multiple literary (...) and cultural traditions and other interdisciplinary perspectives in the discussion, and the need for conceptual models and different case studies that will help develop a global approach in four key avenues of research: global translation flows and translation policies, the post-1989 novel as a global form, global literary environments, and a global perspective on film and cinema history. Gathering contributions from international scholars with expertise in various areas of research, the volume is structured around five target concepts: space, scale, time, connectivity, and agency. In this article, I defend the idea that Kant’s interest in an emergent science in the 18th century as the Embriology (especially in the concept of epigenesis) allows to deepen in a soft naturalization of Kant’s trancendental idealism, as well as to justify the validity of a priori knowledge.

In a recent paper, Barrio, Tajer and Rosenblatt establish a correspondence between metainferences holding in the strict-tolerant logic of transparent truth ST+ and inferences holding in the logic of paradox LP+. They argue that LP+ is ST+’s external logic and they question whether ST+’s solution to the semantic paradoxes is fundamentally different from LP+’s. Here we establish that by parity of reasoning, ST+ can be related to LP+’s dual logic K3+. We clarify the distinction between internal and external logic and (...) argue that while ST+’s nonclassicality can be granted, its self-dual character does not tie it to LP+ more closely than to K3+. Supervaluationism is a well known theory of vagueness. Subvaluationism is a less well known theory of vagueness. But these theories cannot be taken apart, for they are in a relation of duality that can be made precise. This paper provides an introduction to the subvaluationist theory of vagueness in connection to its dual, supervaluationism. A survey on the supervaluationist theory can be found in the Compass paper of Keefe (2008); our presentation of the theory in this paper will be short (...) to get rapidly into the logical issues. This paper is relatively self-contained. A modest background on propositional modal logic is, though not strictly necessary, advisable. Michel Janssen and Harvey Brown have driven a prominent recent debate concerning the direction of an alleged arrow of explanation between Minkowski spacetime and Lorentz invariance of dynamical laws in special relativity. In this article, I critically assess this controversy with the aim of clarifying the explanatory foundations of the theory. First, I show that two assumptions shared by the parties—that the dispute is independent of issues concerning spacetime ontology, and that there is an urgent need for a constructive interpretation (...) of special relativity—are problematic and negatively affect the debate. Second, I argue that the whole discussion relies on a misleading conception of the link between Minkowski spacetime structure and Lorentz invari-ance, a misconception that in turn sheds more shadows than light on our understand-ing of the explanatory nature and power of Einstein’s theory. I state that the arrow connecting Lorentz invariance and Minkowski spacetime is not explanatory and uni-directional, but analytic and bidirectional, and that this analytic arrow grounds the chronogeometric explanations of physical phenomena that special relativity offers. Frost's article advocates for universal models of reading and critiques recent models that concentrate in what has been described as “cracking the orthographic code.” Although the challenge to develop models that can account for word recognition beyond Indo-European languages is welcomed, we argue that reading models should also be constrained by general principles of visual processing and object recognition.
